These Terms of Service ("Terms") govern your access to and use of the Active Vocabulary web application at https://av.studyabroad.xin and the related website at https://www.studyabroad.xin (collectively, the "Service"), operated by Active Vocabulary ("we", "our", or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Account Registration
You must be at least 16 years old to create an account. If you are under 16, a parent or legal guardian must create and manage the account on your behalf. You are responsible for maintaining the confidentiality of your account credentials and for providing accurate account information.
2. Description of Digital Products
Active Vocabulary provides an AI-assisted vocabulary learning platform that includes digital software access, paid membership subscriptions, one-time AI Points purchases, and paid Learning Reports delivered through your account in the web application.
We do not sell physical goods, consulting, tutoring, homework or essay-writing services, marketplace products, resale products, or other services fulfilled outside of Active Vocabulary.
3. Paid Products and Billing
All checkout, payment handling, tax calculation, receipts, refunds, and chargeback handling are provided by Lemon Squeezy as the merchant of record for the transaction. By making a purchase, you agree to the applicable Lemon Squeezy checkout terms and privacy disclosures. We do not store your full payment card details.
Membership subscriptions automatically renew unless cancelled before the renewal date. AI Points are one-time purchases consumed when you use AI-powered features. Learning Reports are one-time purchases providing access to specific report types.
4. Refund and Cancellation Policy
Refunds and cancellations are governed by our Refund and Cancellation Policy, available at https://www.studyabroad.xin/refund-and-cancellation, which is incorporated into these Terms by reference.
5. User Conduct
You agree not to use the Service unlawfully, attempt unauthorized access, disrupt the Service, use unauthorized automation, upload malicious code, or violate intellectual property rights.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Active Vocabulary and its licensors. User-generated learning content remains your property, and you grant us a license to use it solely to provide and improve the Service.
7. Termination
We may terminate or suspend your account and access to the Service if you breach these Terms. If you wish to terminate your account, contact us at info@studyabroad.com.cn.
8. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Active Vocabulary disclaims all warranties, express or implied. AI-generated learning feedback is provided for educational purposes and may contain inaccuracies.
9. Limitation of Liability
To the fullest extent permitted by law, Active Vocabulary shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law provisions.
11. Changes to These Terms
We may modify these Terms at any time by posting updated Terms on this page and updating the "Last updated" date.
